How Exactly Do I File a Petition of Emancipation in Wisconsin?
Question by Captain Beasty: How exactly do I file a Petition of Emancipation in Wisconsin?
Okay, well I’ve been really looking into getting emancipated this year but the internet has been of little help so far. I realize that Wisconsin has no specific laws regarding emancipation but I know it can be done.
Where exactly would I go or who would I need to contact to file a petition?
I am not yet 16 but when I am (In July), I plan on getting a job, saving for a car, & hopefully getting emancipated & moving into an apartment.
I also realize that I would need to give a solid reason as to why I’m looking to be emancipated. Well it’s not anything like my parents are to strict or I don’t like my little sister. I am only 15 years old but I’m more mature & responsible then either of my parents. My mother is a crack head living in an duplex with 2 other drug users in a house that is on the verge of foreclosure. She also is a felon with no job who is facing criminal charges & possible jail time. My father is also a prescription drug abuser. He is bi-polar schizophrenic with no job living off of my grandma, (who is my mother’s mother if I might add, otherwise known as his ex-girlfriend) he currently has no income & he is verbally abusive, occasionally physically abusive, & mentally abusive. I’ve had to grow up living with my parents for nearly 16 years & my younger sister is going through it all over again. One problem is that I don’t want to use this accusations against him in court if the outcome is me being emancipated & my sister going into foster care. Also, I have a disappointing attendance record. Living here I’m terribly anti-social, actually to date haven’t left the house in 2 to 3 weeks (not once!) I truly believe living on my own I will feel safer, my self-esteem would be through the roof, I would eventually take my driver’s test without needing my dad’s consent (which he wouldn’t give because I refuse to drive him to do whatever unnecessary errands he plans on using me for) so I wouldn’t mind going to school & coming home to a quiet, peaceful & utterly UN-stressful environment. I really need to get out before it’s too late. I can’t take 2 more years of any kind of abuse.
Please help. Give what information you can.
Thank You. Thank You. Thank You.

If it has no law it can’t be done.
No state has a 15 year-old Emancipation, moreover you have to be able to provide your own shelter and food, and you are required to go to school.
If you need to get out and their is abuse, emotional or otherwise going on, that is your only way!
